Key Principle

The State's obligation to protect life under Article 2 ECHR extends to taking appropriate care in the planning and control of a security operation so as to minimise risk to the lives of bystanders, and the mere knowledge by the authorities of a killing gives rise ipso facto to a duty to carry out an effective official investigation, irrespective of whether a State agent caused the death or whether the family lodged a formal complaint.
