Key Principle

A commercial third-party litigation funder who funds an unsuccessful claim (or provides security for the defendant's costs) will ordinarily be liable, under the Arnold v National Westminster jurisdiction and s.51 Senior Courts Act 1981, for the defendant's costs on the same (here, indemnity) basis on which those costs are assessed against the funded party.
