Key Principle

Section 382(3) FSMA 2000 is not confined to cases where the court has made a section 382(2) restitution order; it is engaged whenever the FCA has properly received money arising out of a claim under section 382(2) (here roughly £2.5m recovered in the liquidation of an unauthorised land-banking operator), and the court may give directions for its fair distribution to eligible investors.
