Key Principle

On an application to set aside a statutory demand the debtor must establish that the debt is genuinely disputed on substantial grounds; an undisputed indemnity agreement (here, to indemnify the other party against spread-betting losses) gives rise to an enforceable debt that cannot be resisted by unsubstantiated assertions that the transactions fell outside the agreed arrangement.
