Key Principle

Where vehicles supplied to consumers are not of acceptable quality under s 54 of the Australian Consumer Law, the measure of damages under s 272(1)(a) is the reduction in value of the goods assessed by reference to the difference between the price paid (or value of goods as represented) and their actual value as defective, fixed at the time of supply.
