Gibbs v Harding

Key Principle
A testamentary gift to a fluctuating body such as the inhabitants of a locality can take effect only as a charitable trust, and where the purpose is charitable the gift will not fail for uncertainty of objects; a discriminatory reference (here to the 'Black community') that contravenes race-relations legislation is severed/disregarded, leaving a valid charitable trust for the whole community.
