Key Principle

On an application for relief against forfeiture of a lease for non-payment of rent, where there has been no intervening change of position by the landlord, the court will ordinarily grant relief on the tenant paying the arrears of rent and costs, the underlying question being whether the landlord can be restored to the position he would have occupied had the rent been duly paid.
