Griffin Underwriting Limited v Varouxakis

[2021] EWHC 226 (Comm)
JurisdictionUnited Kingdom
CourtHigh Court of Justice, Commercial Court (Queen's Bench Division)
Year2021
StatusPersuasive authority

Key Principle

To obtain a worldwide post-judgment freezing order the applicant must show a good arguable case (here, an existing judgment), that the defendant has assets, a real risk of dissipation such that a judgment will go unsatisfied, and that it is just and convenient to grant the order; the existence of an unsatisfied judgment does not automatically establish risk of dissipation, which must still be proved on the evidence.
