Key Principle

For dishonest assistance, the test of dishonesty is the objective Ivey v Genting test: the court ascertains the defendant's actual state of knowledge or belief as to the facts and then determines whether his conduct was dishonest by the standards of ordinary decent people; blind-eye knowledge requires a firmly-grounded suspicion plus a conscious decision not to inquire, but lesser suspicion may still be imputed to the notional honest person in applying the objective test.
