Key Principle

On an application to amend and to strike out in long-running joint-venture company litigation, the court held it arguable (and not suitable for summary determination) that a claim in knowing receipt may lie in respect of registered land notwithstanding Byers v Saudi National Bank, that parallel unjust enrichment claims may be available, and that a claim under ss.190/195 Companies Act 2006 can be pursued by the statutory derivative procedure.
