Key Principle

For the purposes of Article 1 of the ECHR a State may exercise jurisdiction over a territory it does not effectively control: the territorial State (Moldova) retains a limited positive obligation to take diplomatic and other lawful measures to secure Convention rights, while a State exercising effective authority or decisive influence over a separatist region (Russia, over Transdniestria) bears full responsibility for violations there.
