Key Principle

Where a statute requires a power to be exercised by a Secretary of State personally and the gravity of the decision and the legislative scheme so indicate, the Carltona principle of delegation to officials is displaced; an interim custody order made under the Detention of Terrorists (Northern Ireland) Order 1972 was therefore invalid because it was made by a Minister of State and not considered personally by the Secretary of State.
