The procedural obligation under Article 2 ECHR requires the authorities to conduct an effective investigation capable of identifying and bringing to justice the direct perpetrators of an unlawful killing, and prosecuting only the superior chain of command while failing to pursue credible leads as to the direct perpetrators does not discharge that obligation.
