Key Principle

On an application to set aside a statutory demand under r.10.5 of the Insolvency (England and Wales) Rules 2016 the court has no jurisdiction to determine issues of forum (forum non conveniens / anti-suit), and a debtor cannot resist English bankruptcy jurisdiction merely by relocating abroad once the connecting factors are satisfied.
