Key Principle

Where a claimant has failed to pay an interlocutory costs order, the court may make a peremptory (unless) order requiring payment within a fixed time on pain of the claim being struck out, and refusing a stay of that payment does not infringe the claimant's right of access to the court under Article 6 ECHR.
