Key Principle

A person who has been arrested but not charged cannot, save in exceptional circumstances, obtain an injunction to prevent the press from publishing his identity in connection with information already revealed in open court at a public criminal trial, because the principles of open justice and freedom of expression under article 10 ECHR will ordinarily outweigh his article 8 privacy interest.
