Kim v Park & Ors
[2011] EWHC 1781 (QB)
Key Principle
Where a statement of case is found to be defective, the court should normally refrain from striking it out without first giving the party an opportunity to put the defect right, provided there is reason to believe the defect can be cured; and the principal object of a libel claim is vindication of reputation and prevention of future harm rather than the recovery of damages for past loss.
