Key Principle

On a reverse summary judgment or strike-out application the court may evaluate the evidence and conclude there is no real (as opposed to fanciful) prospect of success without holding a mini-trial, and a claim that is structurally flawed, abusive and lacking pleadable substance — particularly a fraud or conspiracy claim that is improperly pleaded — may be struck out and certified totally without merit.
