Key Principle

On an application to strike out parts of a defence and/or for summary judgment, defences of champerty and maintenance founded on a litigation funding arrangement (including one funded from within Russia or by sanctioned persons) will not be summarily struck out where they raise arguable issues, while plainly unsustainable parts of the defence may be disposed of summarily.
