A foreign State that is party to the New York Convention and has agreed to arbitrate in a Convention country impliedly waives sovereign immunity under the FSIA's waiver exception for proceedings to enforce the resulting award; but an action to enforce a foreign arbitral award remains subject to, and may be barred by, the applicable limitation period.
