Key Principle

To qualify as a dependant under the Fatal Accidents Act 1976 a cohabitant must have been living with the deceased in the same household as husband and wife throughout the two years immediately before death; 'household' has both a physical (a home) and a relational (a settled association/community of life) connotation, and maintaining separate homes may negate a single household.
