Key Principle

Under the Inheritance (Provision for Family and Dependants) Act 1975, a claimant only qualifies as a person 'treated as a child of the family' where there is a 'family' founded on marriage/civil partnership, and a claim as a dependant under s.1(1)(e) requires showing, on a balance-sheet approach, that the deceased made a substantial contribution in money or money's worth towards the claimant's reasonable needs otherwise than for full valuable consideration.
