Lewison J in Easyair Ltd v Opal Telecom Ltd

On an application for summary judgment the court asks whether the respondent has a realistic (not fanciful) prospect of success, must not conduct a mini-trial, but may, where it has all the necessary evidence and the point has been fully argued, grasp the nettle and decide a short point of law or construction.
