Libyan Investment Authority v King

The court has no power to permit amendment to introduce a new cause of action after expiry of the limitation period unless the new claim arises out of substantially the same facts as a claim already in issue; where the existing particulars have themselves been struck out, there is no live claim against which the new claim can be said to arise out of the same facts.
