Unresolved serious allegations and a fundamental breakdown in relationships may render a personal representative's position untenable and justify removal under section 50 of the Administration of Justice Act 1985, even where the allegations have not been adjudicated, and it will only rarely be necessary for such an application to proceed to a trial.
