Key Principle
Exemplary (punitive) damages may be awarded in English law only in three categories: (1) oppressive, arbitrary or unconstitutional action by servants of the government; (2) where the defendant's conduct was calculated to make a profit exceeding the compensation payable to the claimant; and (3) where expressly authorised by statute.
