Ludlow Trust Company Ltd v Homfray

On the construction of a trust settlement, where a beneficiary dies without issue so that the gift over takes effect, the court will give effect to the settlor's intention as expressed in the instrument to determine how the deceased beneficiary's fund is to be distributed among the remaining funds.
