Marashen v Kenvett
[2017] EWHC 1706 (Ch)
Key Principle
The power to permit service by an alternative method under CPR r.6.15 against a defendant abroad only arises if the court has first granted permission to serve out of the jurisdiction (even where the alternative method is effected within the jurisdiction); and where service would otherwise fall under the Hague Service Convention, 'exceptional circumstances' - not merely 'good reason' - are required before alternative service can be ordered.
