Key Principle
A will is to be interpreted using the same principles as a commercial contract — by identifying the testator's intention from the words used in their documentary, factual and commercial context — and where a testator mistakenly executes the wrong document, that document is 'a will' capable of rectification for clerical error under section 20 of the Administration of Justice Act 1982.
