Key Principle

On an application under section 25 of the Civil Jurisdiction and Judgments Act 1982 for a freezing injunction in aid of foreign proceedings, the court will refuse or discharge the order where there are insufficient connecting links between the respondents and England to make it expedient, and serious breaches of the duty of full and frank disclosure at the without-notice stage justify discharge even if a good arguable case and risk of dissipation are established.
