Key Principle

The procedural obligation to investigate under Articles 2 and 3 ECHR is a continuing one not subject to ordinary limitation periods where the State has failed to conduct an effective investigation, and excessive and unjustified delay in investigating deaths and ill-treatment arising from State violence breaches those procedural obligations and Article 6(1).
