Key Principle

On an application to stay enforcement of an English judgment entered upon a foreign judgment pending a foreign appeal, the test under CPR 83.7 is whether there are 'special circumstances which render it inexpedient to enforce' the judgment, and the mere pendency of a foreign appeal is not by itself such a circumstance.
