On a Part 5 POCA 2002 civil-recovery claim, where respondents cannot give a credible lawful explanation for the funds used to acquire and maintain property, the court may infer on the balance of probabilities that the property is recoverable property derived from unlawful conduct (here, drug importation/supply by an organised crime network).
