Key Principle
Where a person dies as a result of force used by State agents, the State must conduct an effective investigation and ensure that any criminal-law response is adequate; a token or suspended sentence, excessive delay and the absence of real punishment of the officers responsible amount to a failure to provide effective protection and an effective remedy under Article 2 ECHR.
