The Devaseelan guidelines on treating an earlier appeal determination as the starting point are not confined to appeals between the same parties but extend to a later appeal by a different appellant (such as a family member) where there is a material overlap of evidence, subject to adaptation according to the nature and materiality of the new evidence.
