PCP Capital Partners LLP v Barclays Bank Plc
[2021] EWHC 307 (Comm)
Key Principle
To establish the tort of deceit a claimant must prove a false representation made knowingly or recklessly with intent that it be relied upon and which the claimant actually and (on the authorities) reasonably relied upon to its detriment; absent proof of such reliance and inducement, a deceit claim fails even where misrepresentations are made.
