Key Principle

The mere fact that an overall successful party failed on some issues does not by itself justify an issue-based costs order; such an order is appropriate only where a discrete or distinct issue caused additional costs, or where costs were materially increased by the unreasonable raising of an issue on which the winner failed, with a percentage reduction usually preferable.
