Key Principle

When determining whether a credit relationship is unfair under section 140A of the Consumer Credit Act 1974, the court may take account of the origins and true nature of the agreement, including dealings between the borrower and the individual who in substance controlled the lender, without first having to establish a formal agency or associate relationship.
