Key Principle

By acceding to Article 54(1) of the ICSID Convention a contracting state submits, within the meaning of section 2 of the State Immunity Act 1978, to the adjudicative jurisdiction of the English courts for the recognition and registration of ICSID arbitral awards, and so cannot rely on state immunity to resist registration (though immunity from execution against its assets under Article 55 is preserved).
