Key Principle

A pay less notice under section 111 of the Housing Grants, Construction and Regeneration Act 1996 is valid provided it makes 'tolerably clear' the sum the payer considers due and the basis on which it is calculated, giving an adequate agenda for adjudication; it need not contain an explicit arithmetical calculation and is not invalidated merely by stating a figure of nil, and the residential occupier exception under section 106 is to be assessed on all the evidence without any single document being treated as a trump card.
