Key Principle

A third party (such as a spouse) asserting a beneficial interest in property subject to a drug-trafficking confiscation order is not, in later civil proceedings, abusively mounting a collateral attack on the Crown Court's determination of that interest, because the Crown Court proceedings determined different issues with a different burden and without the third party having a right to be heard.
