Key Principle

Under Part 26A of the Companies Act 2006 the court may sanction a restructuring plan by cross-class cram down (s.901G) notwithstanding that several classes (here six landlord classes) have voted against it, provided the statutory conditions are met (including that dissenting members would be no worse off than in the relevant alternative) and the court is satisfied it is just and equitable to sanction the plan.
