Key Principle

On a Part VII FSMA 2000 application to sanction a transfer of insurance business, the court will sanction the scheme where, on the evidence of the independent expert and the absence of regulator objection, the scheme is fair and does not adversely affect the security or reasonable expectations of the policyholders of the transferor and transferee.
