Key Principle

There is no serious irregularity under s.68(2)(a) of the Arbitration Act 1996 where the tribunal decides an issue of construction that was 'squarely in play' between the parties even if neither party advanced the precise reasoning adopted; but failure to deal with an issue that was put to it and is not disposed of by another finding may amount to a s.68(2)(d) irregularity.
