Key Principle

Where a party challenges, under CPR 3.3(5)(a), an order the court made of its own initiative, the court should address that challenge before treating the party as in breach; relief from sanctions and strike-out under the Denton framework must not be applied so as to deprive a litigant of the chance to be heard on the validity of the original order.
