Key Principle
For a misrepresentation claim, including one under s.2(1) of the Misrepresentation Act 1967, a representation is not false where it is substantially correct, and an alleged inducing factor must be a 'real and substantial' part of what induced the representee to contract — a factor merely observed, considered or which supports the decision is insufficient to establish causative inducement.
