A claimant who serves a claim form out of the jurisdiction (where permission is not required) without filing and serving the notice required by CPR 6.34 (Form N510) cannot validate the defective service by obtaining relief from sanctions under CPR 3.9; the consequences are governed by the service rules (CPR 6/7.6), which on the facts could not be satisfied.
