In a libel claim the defence of truth (substantial justification) succeeds where the defendant proves that the imputations are substantially true; serious harm to the claimant's reputation under section 1 of the Defamation Act 2013 does not save the claim if the defamatory imputations (here describing the claimant as a self-confessed and known fraudster and an online troll) are shown to be true.
