Key Principle
An employers' liability insurer's claim for contribution from another insurer on risk in respect of an indemnity paid for a mesothelioma claim is a claim for 'damage' within the Civil Liability (Contribution) Act 1978, and so is subject to the two-year limitation period under section 10 of the Limitation Act 1980.
