Key Principle
The 'without prejudice' rule, founded on the public policy of encouraging settlement, renders inadmissible communications genuinely aimed at settling a dispute, and that protection extends to subsequent proceedings between one of those parties and a third party, so that without-prejudice negotiations which result in a settlement remain privileged and need not be disclosed to other parties in the same litigation.
